ORAL ORDER

Learned counsel Smt. Chandwani Sonam.R., accepts notice for respondent nos.1 to 3. Learned counsel Sri N Ambarisha accepts notice for respondent no. 4.
2. The petitioner is before this Court seeking for the following reliefs;

(i) Issue a writ or such other order in the nature of certiorari to quash the order dated 30.08.2024 bearing No.24-07020(06)/2 /2022/RC B'lore/CD/ NOC-AB bearing office
order No.363/2024 passed by the R-3 produced Annexure-J.
(ii) Issue a writ or such other order in the nature of mandamus directing the respondents to issue NOC to the petitioner in order to join employment of "Grade A" under the Karnataka State Government as per Notification dated 30.10.2024 produced at ANNEXURE-C.
(iii) Pass such other orders as this Hon'ble Court deems fit to grant in the interest of justice and equity.
3. The petitioner is a Para-olympian, who has been awarded with Arjuna Award, Padma Shree, Rajyotsava Award and certain other awards. He had applied to respondent no.1 for issuance of a No Objection Certificate ('NoC') for the purpose of his employment. The said application came to be rejected by the respondent in terms the order dated 30.08.2024 at Annexure-J, on the ground that there is an enquiry which is pending against the petitioner.
3.1 The said enquiry was challenged by the petitioner in Writ Petition No.19661/2025, which came to be disposed by this Court on 09.07.2026 recording the submission of the complainant that the Paralympic Committee of India did

not wish to prosecute the complaint and it had in fact withdrawn the complaint, which had also been informed to respondent nos.1 to 3 as far back as on 20.08.2024 and reiterated on 08.11.2024.
4. Surprisingly, for the last two years, despite the withdrawal of the complaint, the matter is still pending for enquiry. Now that the enquiry has been quashed in Writ Petition No.19661/2025, there is no impediment for respondent nos.1 to 3 to consider the application of the petitioner for grant of 'NoC'.
5. In that view of the matter, this Court passes the following
order;
(i) Writ petition is allowed.
(ii) A certiorari is issued quashing the order dated 30.08.2024 at Annexure J.
(iii) A mandamus is issued directing respondent nos.1 to 3 to consider the application filed for issuance of NoC in terms of applicable law and

pass necessary orders within a period of 30 days from the date of receipt of a copy of this
order.
