THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this court seeking for the following reliefs: "A) To issue a Writ in the nature of Mandamus or any other appropriate writ, order or direction to the respondents to consider the representation in No 118/2025-26 dated 11.02.2026 is produced at ANNEXURE-A. B) Any other order or direction may be issued". 2. Petitioner had participated in a tender issued by respondent No.2 and having been the successful, an agreement came to be executed on 29.12.2022, in pursuance of which, the petitioner claims to have - 3 - HC-KAR NC: 2026:KHC:35140 WP No. 20808 of 2026 completed the work and raised his invoices which are yet to be paid. 3. The petitioner therefore had submitted a representation on 11.02.2026 at Annexure-A, which also not having been considered, it is in that background that the petitioner is before this court seeking for the aforesaid reliefs. 4. Whenever any works are carried out by a contractor under a contract/agreement/work order, it is but required for the concerned authority to make payments as per the applicable contractual terms. In the present case, the same not having been done, a representation has been submitted. Even when such a representation has been submitted, it is required for the respondents to have either accepted or rejected the representation within a reasonable period of time. 5. Needless to say if an order of rejection was passed, it was to be accompanied by reasons. - 4 - HC-KAR NC: 2026:KHC:35140 WP No. 20808 of 2026 6. None of the above having occurred, this Court passes the following: ORDER. (i) Writ petition is allowed. (ii) A mandamus is issued directing the respondents to consider the representation dated 11.02.2026 at Annexure-A submitted by the petitioner in accordance with the contractual terms and tender documents within a period of 30 days from the date of receipt of copy of the order.
