O R D E R
1. This Criminal Revision Case has been filed by the petitioner/complainant under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for short, ‘the Cr.P.C.’) against the order dated 23.10.2018 passed in Crl.M.P.No.1725 of 2018 in C.C.No.185 of 2017 on the file of the learned Principal Judicial Magistrate of First Class-cum-Metropolitan Magistrate, Vijayawada (for short, ‘the trial Court’).
2. Heard and perused the record.
3. As seen from the record, the Crl.M.P.No.1725 of 2018 has been filed by the petitioner/complainant herein under Section 319 of Cr.P.C to add M/s. Viyyan Silks Private Limited, Visakhpatnam as accused No.3 in this case and issue summons for taking cognizance of offence against accused No.3. By
order dated 23.10.2018, the trial Court dismissed the petition. Against the said
order, the petitioner herein preferred the revision.
4. A report was received from the Principal District Judge, Krishna, Machilipatnam. In the report, the learned Magistrate submitted that C.C.No.185 of 2017 was disposed of by acquitting accused Nos.1 and 2 under Section 255(1) of Criminal Procedure Code. In view of the disposal of C.C.No.185 of 2017, this Court finds that the cause does not survive for adjudication and the matter would become infructuous.
5. Accordingly, the Criminal Revision Case is dismissed as infructuous. Interim orders granted earlier, if any, shall stand vacated and the miscellaneous applications pending, if any, shall stand closed.
