The present intra-court appeal has been instituted challenging the writ order dated 09.01.2026 passed in W.P.No.178 of 2026. 2. The writ petitioner is the appellant. The appellant joined the Government Service on 22.01.2010. He made an application to Tamil Nadu Public Service Commission [TNPSC] seeking alteration of his Date of Birth on 12.03.2012. The said application was rejected by TNPSC on the ground that they are incompetent authority. Thus, the petitioner again submitted an application before the second respondent on 15.09.2012. The learned counsel for the appellant would mainly contend that the appellant enclosed a copy of the Birth Certificate issued by the Sub-Registrar, Sulur. A perusal of the Birth Certificate would show that the appellant submitted an application seeking Birth Certificate in the year 2024 and it was issued on 03.09.2024 by the Sub-Registrar, Sulur. It is not made clear whether the Sub-Registrar has verified any of the original Birth Register or relevant records for issuance of such certificate. Based on the application submitted by the appellant, the Birth Certificate appears to have been issued, which cannot be the basis for altering the Date of Birth of the appellant in his service records. It is not in dispute that all along right from his school education, the Date of Birth of the appellant has been entered as 07.07.1965. Now he is claiming his Date of Birth as 24.04.1966 merely based on the Birth Certificate issued by the Sub-Registrar on 03.09.2024, which cannot be the basis for altering the Date of Birth by invoking the provisions of the Service Rules. Therefore, the appellant has not made out a case of alteration of Date of Birth and the writ Court has approached the issues in a right perspective and no interference is called for. Accordingly, the writ appeal stands dismissed. No costs. (S.M.S.,J.)
