Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 1 month and the recovery in the present case is 502 grams of brown sugar.
Learned advocate appearing for the State submits that there are antecedents of the present petitioner and so far as the present case is concerned, the co-accused has named the present petitioner.
Having considered the period of detention of the present
2 petitioner for 1 year 1 month and there are no recoveries pursuant to arrest of the present petitioner, I am inclined to release the present petitioner on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Ankit Kumar @ Anikit shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without the prior permission of the learned special court.
Thus, CRM(NDPS) 1047 of 2026 is allowed.
