The petitioners seek parity with the co-accused who has been granted bail earlier. Learned counsel for the State does not oppose the said fact. In view of the fact that the petitioners are similarly circumstanced with the co-accused on bail, they deserve the same benefit. Accordingly prayer for bail is allowed. The petitioners Jharna Sarkar @ Sabita and Sadhan Sarkar be released on bail upon furnishing bond of Rs.30,000/- (Rupees Thirty Thousand only) each, with two
2 sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 1st Court, 1st Court, Coochbehar subject to condition that they shall not leave the jurisdiction of learned Trial Court. They shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. In the event the petitioners fail to comply with any of the conditions as mentioned above without justifiable cause, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court. The application for bail being CRM 613 of 2025 is, thus, disposed of. Case Diary be returned. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
