[2] The learned counsel appearing for the petitioner however submitted that through bonafide inadvertence, the present writ petition has been filed by the petitioner instead of filing of an appeal as provided under Section 18 of the SARFAESI Act or any other relevant provisions and as such, an appropriate observation may be made by this Court that in the event, the present writ petitioner files an appeal under Section 18 of the SARFAESI Act or any other relevant provisions of law, the time taken from the date of filing this writ petition, i.e., from 13.04.2026 till today, i.e., 04.05.2026, be exempted by the appellate tribunal while computing the period of limitation for filing such appeal. [3] In view of the submission made by the learned counsel appearing for the petitioner and on careful consideration WP (C) No. 282 of 2026 Page 3 of the pleadings made in this writ petition as well as the provisions of law of the SARFAESI ACT, this Court is of the considered view that it will be in the interest of justice to issue the following directions:- (1) Leave granted. The present petition is hereby closed as being withdrawn with liberty as sought for. (2) It is made clear that in the event, the petitioner approached the appropriate appellate tribunal by filing an appeal as provided under Section 18 of the SARFAESI Act or any other relevant provisions of law, the period from the date of filing this writ petition, i.e., 13.04.2026 till today, i.e., 04.05.2026 shall be condoned by the appellate tribunal at the time of computation of the limitation period for filing such an appeal.
