Respondents (Cause-title taken from the Case Information System) ----------------------------------------------------------------------------------------------- For Petitioner :- Mr. Akath Kumar Yadav, Advocate For State :- Mr. Shreyansh Mehta, P.L. ----------------------------------------------------------------------------------------------- SB- Hon'ble Shri Justice Amitendra Kishore Prasad Order On Board 21.07.2026 1. Following reliefs have been prayed in this petition:- “10.1 The Hon'ble Court may kindly be pleased to allow the writ petition filed by the peitoneer at the motion stage and to pass the necessary orders for correction of the record in pursuance of an order passed Nayab Tahsidar Baloda, District Janjgir- Champa (C.G.) 10.2 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the petitioner is a bona fide purchaser of the subject land by virtue of two registered sale deeds dated 07.03.2018 and 20.03.2018, executed by respondent No. 4 and the other co-bhumiswamis. It is contended that, pursuant to the said sale deeds, mutation proceedings were initiated and the Nayab Tahsildar, Baloda, by orders dated 24.08.2018 and 01.12.2018 passed in Revenue Case Nos. 76/A-6/2017-18 and 77/A-6/2017-18, respectively, directed correction of the revenue records. Despite the said orders having attained finality, the concerned Halka Patwari has failed to carry 3 out the necessary corrections in the revenue records. It is submitted that repeated requests made by the petitioner before the revenue authorities have yielded no result. Therefore, the petitioner has been constrained to invoke the extraordinary jurisdiction of this Court seeking a direction to the competent revenue authorities, particularly the Nayab Tahsildar and the Halka Patwari, to implement the orders dated 24.08.2018 and 01.12.2018 and carry out the consequential correction of the revenue records within a time-bound period. 3. Learned State counsel submits that the matter is pending since the year 2024 and, therefore, it is possible that either the name of the petitioner has already been mutated in the revenue records or the orders passed by the competent revenue authority have been challenged before the higher authority. 4. I have heard learned counsel for the parties and perused the record. 5. Upon perusal of the record, it appears that the Nayab Tahsildar, Baloda has already passed orders dated 24.08.2018 and 01.12.2018, whereby the concerned Halka Patwari was directed to mutate the name of the petitioner in the revenue records as well as in the online computer records in respect of the land in question. In absence of any material placed on record to indicate that the aforesaid orders have either been stayed, modified, or 4 challenged before any competent higher authority, the concerned authorities are required to ensure compliance of the said orders. 6. Accordingly, the concerned Tahsildar/Nayab Tahsildar is directed to ensure compliance of the orders dated 24.08.2018 and 01.12.2018. In case the mutation has not yet been carried out, the concerned Halka Patwari shall immediately mutate the name of the petitioner in the relevant revenue records as well as in the online records pertaining to the land in question. 7. The concerned Tahsildar shall submit a compliance report before the Registrar (Judicial) of this Court within a period of 15 days from the date of compliance of the aforesaid directions. The concerned authority shall ensure completion of the entire exercise within a period of 30 days from the date of receipt of a copy of this order. 8. With the aforesaid directions, the writ petition stands disposed of. sd/- (Amitendra Kishore Prasad) Judge Vishakha
