This application under Article 227 of the Constitution of India is at the instance of the wife praying for a direction upon the learned Additional District Judge, 3rd Court at Barrackpore to dispose of Matrimonial Suit No. 812 of 2021 expeditiously. Learned advocate appearing for the petitioner submits that an application for alimony pendente lite for the minor daughter filed by the husband/opposite-party herein is pending. He further submits that the opposite-party filed an application seeking restitution of conjugal rights by way of counter-claim under Section 23A read with Section 9 of the Hindu Marriage Act. From the
order-sheets appended to this application this Court finds that July 30, 2026 has been fixed for hearing of the application for alimony pendente lite for the minor daughter. It appears from the order dated June 10, 2026 that the learned trial judge has specifically observed therein that the application filed on May 5, 2025 for alimony pendente lite should be heard first.
2 In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this
order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioner CO 2215 of 2026 stands disposed of by requesting the learned Additional District Judge, 3rd Court at Barrackpore to take up the hearing of the application dated May 5, 2025 for alimony pendente lite of the minor child on the next date fixed, i.e., on July 30, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the said application, the learned trial judge is requested to proceed with the hearing of the Matrimonial Suit No. 812 of 2021 in accordance with law and make an endeavour to dispose of the same as expeditiously as possible.
