In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chapra Police Station Case No. 1541 of 2025 dated 10.12.2025 for the offences punishable under Sections 85/80/3(5) of the Bharatiya Nyaya Sanhita, 2023. -And-
In the matter of: Dhulo Biswas & Ors. …Petitioners
Mr. Prabir Majumder Mr. Snehansu Majumder Ms. Sangeeta Chakraborty …for the Petitioners
Mr. Koustav Lal Mukherjee …for the State
1. Memo of evidence submitted be kept with the record. 2. Learned advocate appearing for the petitioners submits that petitioner No. 1 is the father-in-law, petitioner No. 2 is the mother-in-law, petitioner No. 3 is the brother-in-law, petitioner No. 4 is the sister-in-law and petitioner No. 5 is the grandmother- in-law of the deceased. All of them have been implicated in the present case. 3. Learned advocate appearing for the petitioner submits that marriage was solemnized about an year ago. There was trivial dispute which escalated and finally, the unfortunate incident happened. 2
4. On the other hand, learned advocate appearing for the State opposed the prayer for anticipatory bail and submitted that all these petitioners were involved in the regular torture being inflicted upon the deceased. 5. I have taken into account the post-mortem report which does not reflect any physical injuries being inflicted and prima facie, it reflects that the deceased has died by way of hanging. As it has been informed that the husband has been arrested and is in custody and charge-sheet has already been submitted, having regard to the totality of the circumstances, I am of the view that for the purpose of investigation, the custodial detention of the petitioners may not be warranted. 6. Accordingly, prayer for anticipatory bail of the petitioners, namely, Dhulo Biswas, Serina Biswas, Suman Biswas, Sabina Biswas and Arbi Biswas @ Arbichon Biswas is allowed. 7. In the event of arrest, the petitioners shall furnish bond to the satisfaction of the Arresting Officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 8.
Since charge-sheet has already been submitted before the learned Jurisdictional Court, this order of anticipatory bail would be valid for a period of six weeks. 9. With the aforesaid observation, C.R.M. (A) 960 of 2026 is disposed of. 3
10. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court. 11. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
