IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 207 CRM-M-33803-2026 (O&M) Date of Decision: 09.07.2026 CHAMAN LAL ....Petitioner V/s STATE OF PUNJAB AND ANOTHER .…Respondent CORAM: HON'BLE MR. JUSTICE VIKRAM AGGARWAL Present: Mr. Arshdeep Singh Khaira, Advocate for the petitioner. Mr. Rahul Jindal, AAG, Punjab. Mr. A.S. Manaise, Advocate for the complainant. *** VIKRAM AGGARWAL, J. (ORAL) Prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the “BNSS”) is for the grant of anticipatory bail in case FIR No.64, dated 20.05.2026 under Sections 318(4) and 61(2) of BNS, 2023 registered at Police Station Division C, District Police Commissionerate, Amritsar. 2. On a complaint submitted by one Gurvail Singh, the FIR in question was registered. The petitioner is alleged to have been working as a Manager in a dairy farm being run by the complainant. The allegation is that co-accused Dalbir Singh and Gulzar Singh had kept cows and buffaloes and were supplying milk to the dairy of the complainant every day. As per the complainant, his dairy farm used to purchase about 650 Kg of milk every day from the said Dalbir Singh and Gulzar Singh. The petitioner who was working as a Manager in the dairy farm, in collusion with the said Dalbir MANI KUMAR 2026.07.10 19:05 I attest to the accuracy and integrity of this document CRM-M-33803-2026 (O&M) -2- Singh and Gulzar Singh used to make an entry of 650 Kg, whereas actually the milk supplied was only 500 to 550 Kg. It was alleged that the said collusion was going on for the last 3 to 4 years which led to embezzlement of about Rs. 10,000/- to 15,000/- every day. After the registration of the FIR, it was found by the investigating agency that the petitioner had committed a fraud of about Rs.76 lakhs with the complainant. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that it is not believable that somebody would be taking about 100 litres less milk for a period of 2 to 3 years without the same being detected by the owners of the dairy firm who were further selling the milk. He submits that the petitioner has clean antecedents and is willing to join investigation and abide by any condition imposed by the Court. 4. Per contra, learned State counsel and learned counsel for the complainant have opposed the bail application, stating that custodial interrogation would be essential. 5. I have considered the submissions made by learned counsel for the parties. 6. The allegations are serious. The petitioner, who as per the complainant, was their trusted employee, is alleged to have colluded with co-accused Dalbir Singh and Gulzar Singh and made wrong entries in the accounts as regards the quantity of milk purchased from the said Dalbir Singh and Gulzar Singh, causing a loss of about Rs.76 lakhs to the complainant. Since the allegations are directly against the petitioner, this Court does not find it a case, where the concession of anticipatory bail MANI KUMAR 2026.07.10 19:05 I attest to the accuracy and integrity of this document CRM-M-33803-2026 (O&M) -3- should be extended. In the considered opinion of this Court, custodial interrogation would be essential to elicit the truth. 7. That being so, the petition is found to be devoid of merit and is accordingly dismissed.
