JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: i. To quash the order dated 16.04.2026 in the form of proceedings, which was passed by respondent No.2 herein vide its Show Cause No.KA06/2026/125 (Annexure-A). ii. To pass such other order or direction as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity. 2. Learned counsel appearing for the petitioner submits that the show cause notice was issued on 04.04.2026 which was received by the petitioner and on 16.04.2026 RTO, Tumkur has suspended the driving license. It is submitted that without giving an opportunity to the petitioner the RTO, Tumkur has issued the proceedings. It is submitted that the order is passed without following principles of natural justice and the same is liable to be set aside. - 3 - HC-KAR NC: 2026:KHC:33687 WP No. 20270 of 2026 3. Learned HCGP who takes notice on behalf of respondent Nos.1 and 2 submits that as per Rule 4 of the Karnataka Motor Vehicles Rules, 1989 the appeal lies to the Deputy Commissioner, Transport Department. Petitioner without availing the alternative remedy has come before this court and the petition has to be dismissed on that ground alone. 4. Having heard the learned counsels on either side, perused the entire material on record. Considering the fact that there is a right of appeal available to the petitioner and without availing the same, the petitioner has come up before this court. 5. Accordingly, this court is passing the following: ORDER i. The writ petition is disposed of giving liberty to the petitioner to avail the appropriate remedy before the Deputy Commissioner, Transport Department, Bangalore within a period of one - 4 - HC-KAR NC: 2026:KHC:33687 WP No. 20270 of 2026 week from the date of receipt of the copy of the order. ii.
