The petitioner who is the Pradhan of Sayestanagar No. 1 Gram Panchayat has assailed the no confidence motion submitted by the majority members of the Panchayat being the private respondents herein seeking her removal, before the Prescribed Authority on May 19, 2026 primarily on the ground that the motion contains stigma against her. Learned counsel for the private respondents, in his usual fairness, submits that the motion contains stigma and needs to be quashed/cancelled. On perusal of the no confidence motion, it appears that there are allegations of inefficiency and nepotism against the Pradhan which definitely amounts to stigma. In view of the above, the no confidence motion submitted on May 19, 2026 is set aside/quashed. Further steps taken by the Prescribed Authority consequent to the said motion are also quashed. Liberty is granted to the private respondents to submit a fresh motion in terms of Section 12 of the West Bengal Panchayat Act, 1973. On receipt of the motion, the Prescribed Authority shall deal with the same in accordance with Section 12 of the Act, particularly the time frame stipulated therein. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
