(PIL) No. 5565/2019. 2. It has been contended on behalf of the petitioner that the order has yet not been complied with, as the encroachments are still available. 3. Learned counsel appearing on behalf of the concerned opposite party, i.e., Deputy Commissioner, Palamau at Medininagar (Daltonganj) has submitted that a show cause has been filed and it has been found by the Collector that the encroachments are there and as such, the decision has been taken to initiate a proceeding under the Jharkhand Public Land Encroachment Act being Case No. 01/2025-26 and accordingly, notices have been issued upon the alleged encroachers for removal of the encroachments. 4. Learned counsel appearing for the concerned opposite party therefore has submitted that the order passed by this Court has been complied with. 5. Learned counsel appearing for the petitioner has submitted that once the Collector has remitted the factum of encroachment over the government 2026:JHHC:8912-DB 2 land, then, the proceeding which has been initiated, even as per the mandate as available under the Public Land Encroachment Act is to be disposed of expeditiously, i.e., within time frame as stipulated therein. 6. It has been submitted that the notices have been issued on 30.07.2025, but even after lapse of about substantial period, the proceeding is still said to be pending before the Circle Officer, the Collector within the meaning of Encroachment Act. 7. On this, the learned counsel appearing for the opposite party has submitted that all sincere endeavour will be taken to get the encroachment proceeding disposed of as early as possible and the government land will be made encroachment free. 8. This Court, considering the aforesaid undertaking furnished by the learned counsel appearing for the concerned opposite party, is of the view that there is no need to proceed further with the contempt case. 9.
