Dr. Saptarshi Bishnu Versus The State of West Bengal & Ors.
Mr. S. Ghosh, Mr. M. N. Roy, Mr. G. Haldar, Mr. B. Nandy ...for the Petitioner Ms. Chandreyi Alam, ld. A.G.P., Ms. Ranjana Chatterjee ...for the State
1. Mr. M. N. Roy, learned advocate appearing for the petitioner, submits on instruction that he wants to withdraw the writ petition, so as to avail remedy before the Single Judge Bench taking up the determination of service matters.
2. He further submits that since the West Bengal Administrative Tribunal (for short ‘Tribunal’) is not functional for want of a member, he cannot withdraw the Original Application for availing remedy before the Writ Court.
3. In view of such submission, we dispose of the present Writ Petition, as also the Original Application bearing O.A. No. 591 of 2025, pending before the Tribunal, with liberty to the petitioner to avail remedy, as prayed for.
