At the very outset, learned counsel appearing for the parties jointly submit that the issue involved in this petition is no longer res integra and this petition is squarely covered by the judgment passed by Hon’ble Division Bench in batch of writ appeals leading Digitally signed by AJINKYA PANSARE Date: 2026.07.23 10:57:10 +0530 2 case of which being WA No. 501 of 2022 parties being Abhishek Kumar Nirmalkar Versus State of Chhattisgarh and Others which was decided on 10.2.2023. 2. In the light of the submission made herein-above, this Court is of the opinion that this petition is squarely covered by the judgment rendered by Hon’ble Division Bench in WA No. 501 of 2022 & bunch of writ appeals decided on 10.2.2023 in case of Abhishek Kumar Nirmalkar Versus State of Chhattisgarh and Others. 3. Accordingly, this petition is allowed in terms of the order passed by Hon’ble Division Bench in the case of Abhishek Kumar Nirmalkar (supra) holding that the SC/ST/OBC candidates are entitled to 5% relaxation in their academic qualifications and such of the writ petitioner who would consequently fulfill the minimum qualification shall be entitled to be appointed pursuant to the advertisement dated 9.3.2019.
