The petitioner is apprehending his arrest in connection with Sisai P.S. Case No.118 of 2025 for the alleged offences registered under Sections 303(2), 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 4/54 of Jharkhand Minor Mineral Concession Rules, 2004 and under Rule 7/9 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned Sub-Divisional Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner of storing 6000 cft. of sand in Khata No.19 and Plot No.786 and 787. He further submits that the petitioner has nothing to do with the storage of said sand. 2026:JHHC:9691 --2-- A.B.A. No. 1380 of 2026 He then submits that the allegation of storing said sand is against Munna Soni. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioner has come on suspicion from unknown villagers. 5. Considering that the name of the person, who has taken the name of the petitioner, has not been disclosed in the FIR and in the FIR the allegations are made that Munna Soni has stored the said sand and the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
