JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.60/2026 registered by Sampigehalli Police Station, Bengaluru City for the offences punishable under Sections 20(a) and 8(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act') is before this Court in this petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. - 3 - HC-KAR CNR: KAHC010366822026 NC: 2026:KHC:36069 CRL.P No. 7646 of 2026 3. FIR in Crime No.60/2026 was registered by Sampigehalli Police Station, Bengaluru City for the aforesaid offences against unknown persons and the petitioner herein based on the first information received from Sri.Kupendra H.C, Police Officer attached to Sampigehalli Police Station. Apprehending arrest in the said case, the petitioner has filed Crl.Misc.No.2382/2026 before the jurisdictional Sessions Court, which was rejected on 18.03.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that in the vacant site allegedly belonging to the petitioner, one Ganja Plant totally weighing 915 grams has been recovered in the present case and thereafter, FIR was registered against the petitioner in Crime No.60/2026. The seized contraband article is of small quantity and the petitioner has no criminal antecedents. Under these circumstances, I am of the opinion that the petitioner has - 4 - HC-KAR CNR: KAHC010366822026 NC: 2026:KHC:36069 CRL.P No. 7646 of 2026 made out a case for grant of anticipatory bail. Accordingly, the following: ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.60/2026 registered by Sampigehalli Police Station, Bengaluru City for the offence punishable under Sections 20(a) and 8(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within fifteen days from the date of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the investigating officer/jurisdictional Court. - 5 - HC-KAR CNR: KAHC010366822026 NC: 2026:KHC:36069 CRL.P No. 7646 of 2026 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
