CORAM: HON’BLE MR. JUSTICE SUJIT NARAYAN PRASAD HON’BLE MR. JUSTICE NAVNEET KUMAR
For the Petitioners : Mrs. Bibha Bakshi, Advocate ----- 09/11.10.2023 Although this case has been listed on Board with an office note for passing appropriate order in interlocutory application being I.A. No.3205 of 2023 for ignoring the defect, but it appears from the order dated 21st March 2023, this Court has allowed two weeks’ time to remove the defect with an specific direction that if the defect will not be removed, the writ petition shall stand dismissed without further reference to the Bench.
2. Admittedly the defect had not been removed within the stipulated period as directed by this Court by order dated 21st March 2023 and as such, in consequence of the pre-emptory order, the instant writ petition is said to be dismissed, however, no memo to that effect has been given by the office, but the fact remains that the writ petition is to be treated dismissed in pursuance of the order dated 21st March 2023.
3. In this view of the matter, the necessity as of now is to file restoration application.
4.
Learned counsel appearing for the writ petitioner has sought for time to file restoration application.
5. Accordingly, there is no need to pass further order.
6. The office is directed to do the needful in terms of the order dated 21st March 2023.
