Briefly stated, the case of the prosecution is that on 18.02.2026, at about 12:30 p.m., the deceased, Kumari Jyoti Dahire, allegedly consumed rat poison at the P.G. College Ground, Kawardha. Thereafter, co-accused Devkumari Dahire admitted her to the District Hospital, Kawardha, informed the present Applicant, and both looked after her during her treatment. As her condition deteriorated, she was referred to Mekahara Hospital, Raipur, on 23.02.2026, where she remained under treatment until 27.02.2026, when she succumbed to the poisoning. During the merg enquiry and subsequent investigation, the statements of the deceased's family members and other witnesses were recorded, wherein it surfaced that the present Applicant had been in a relationship with co-accused Devkumari Dahire for the last 5– 6 years and had also developed a relationship with the deceased about six months prior to the incident, while concealing both relationships from each other. It is alleged that after the deceased came to know about the relationship between the present Applicant and the co-accused, she insisted that he sever his ties with the co-accused, however, he refused as he wished to continue both relationships. This 3 led to disputes between the deceased and the present Applicant. On 18.02.2026, shortly before the incident, an altercation allegedly took place between the deceased and the co-accused at the P.G. College Ground regarding the present Applicant. It is further alleged that the deceased left the place after seeking Rs.50 from the present Applicant and after about half an hour, returned vomiting, whereupon the co-accused admitted her to the hospital. Accordingly, after investigation, the present crime came to be registered against the Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that the deceased and co-accused Dev Kumari had quarrelled with each other on account of their relationship with the present Applicant, as both of them objected to the Applicant's relationship with the other. It is further submitted that the deceased, on her own, consumed poison and there is no material to show that the Applicant had abetted the commission of suicide. It is also submitted that co-accused Dev Kumari has already been granted regular bail and considering the fact that the trial is likely to take considerable time for its conclusion, the Applicant deserves to be granted the benefit of anticipatory bail. 4 4. On the other hand, learned State Counsel opposes the application and submits that the present Applicant was maintaining a relationship with both the deceased and co- accused Dev Kumari simultaneously, which led to frequent disputes between them. It is contended that the deceased consumed poison on account of the conduct of the present Applicant and therefore, sufficient material is available in the case diary indicating his involvement in the commission of the offence. It is further submitted that the case of the present Applicant stands on a different footing from that of co- accused Dev Kumari, who has already been granted regular bail. Accordingly, it is prayed that the application be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature and gravity of the allegations, the fact that the deceased allegedly consumed poison, the material collected during investigation indicating that the alleged conduct of the present Applicant forms the basis of the prosecution case and further considering that the case of co-accused Dev Kumari, who has been granted regular bail, stands on a different 5 footing, this Court is not inclined to extend the extraordinary discretionary relief of anticipatory bail to the Applicant. 7. Accordingly, the Anticipatory Bail application of the Applicant – Tuleshwar Kurre, filed under Section 482 of the BNSS, 2023 in connection with Crime No.229/2026, registered at Police Station – Kotwali, Kawardha, Kabirdham, District Kabirdham (C.G.) for alleged commission of offences punishable under Sections 108 and 3(5) of BNS, is hereby rejected. 8.
