It is submitted that a writ petition bearing WPS No.2770/2024 (Dr. Smt. Sunanda Marawi vs. State od Chhattisgarh and others) was filed seeking seeking a direction to the respondent authorities for grant of selection grade pay w.e.f. 2005, revised pay of ₹9,000/- w.e.f. 2008, further revised pay of ₹10,000/- w.e.f. 2011, and consequential benefits, including arrears and interest @ 12% per annum. The Hon’ble Court has been pleased to allow the writ petition vide order dated 20.05.2025; however, in the concluding paragraph 10, due to a clerical and typographical error, the expression ‘on emergency basis’ has been typed, whereas it ought to have been ‘on regular basis’. Further, after the expression ‘for grant of selection grade’, the words ‘with effect from 2005’ have been omitted. Therefore, the relief granted is not in terms of the specific prayer, and consequently, the relief granted has become inexecutable. Hence, the MCC application has been filed. 2. Following prayer has been made in the MCC application. “It is therefore most respectfully prayed that the Hon'ble Court may be kind enough to allow the instant application and may be pleased to modify the order dated 20.05.2025 to the extent of replacing the expression "on emergency basis" with the expression "on regular basis" in the sixth 3 line of paragraph 10 of the order and may further be pleased to insert "with effect from the year 2005" after the expression "for grant of selection grade" in the sixth line of paragraph 10 of the order dated 20.05.2025 in the interest of justice.” 3. For the reasons stated in the MCC application, and upon a careful perusal of the record as well as the order dated 20.05.2025 passed in WPS No. 2770/2024, it is apparent that in paragraph 10 of the said order, the expression “on emergency basis” has been inadvertently mentioned due to a clerical and typographical error, whereas the same ought to have been “on regular basis”. It is further evident that after the expression “for grant of selection grade”, the words “with effect from the year 2005” have been inadvertently omitted. 4. Accordingly, the MCC application is allowed, and the order dated 20.05.2025 is modified to the extent that the expression “on emergency basis” appearing in the sixth line of paragraph 10 shall stand replaced by “on regular basis”, and the words “with effect from the year 2005” shall be inserted after the expression “for grant of selection grade” in the sixth line of paragraph 10 of the said order. 5. The order dated 20.05.2025 passed in WPS No. 2770/2024 (Dr. Smt. Sunanda Marawi vs. State of Chhattisgarh and others) shall 4 stand modified to the aforesaid extent only, and the aforesaid order shall otherwise remain intact.
