The impugned notice has been issued to measure the land for verifying whether there is any encroachment. The petitioner has approached this Court to pre-empt such action, which is not permissible under law. The respondent shall carry out survey of the property, which should be conducted in the presence of the petitioner as well as the other owners of the land. 2. A copy of the survey report shall be served on the petitioner herein. If the petitioner is aggrieved by the report in any manner, it is open to him to agitate the issue before the appropriate forum. We, therefore, dispose of this Writ Petition as premature. Consequently, the connected Miscellaneous Petition is closed. No costs. (G.J.,J.)
