THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 36842 of 2017 ORDER:
The present writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking the following main relief:
“to declare the action of the respondents 1 to 4 in not considering the representation dated 21.10.2017 for seeking the death benefits of my husband and also seeking compassionate appointment is illegal, arbitrary and volatile of Article 14, 19 and 300-A of the Constitution of India and consequently, direct the respondents to consider the case of the petitioner on compassionate ground.”
2.
Today, there is no representation on behalf of the petitioner. 3. The entire grievance of the petitioner is that her representation dated 21.10.2017 addressed to the respondent No.4 is not redressed. Apparently, no counter was filed by the respondents till date. It is the case of the petitioner that her husband was working in respondent No.2 since 2011 and that he expired on 21.08.2017, leaving behind the petitioner as his legal representative. In order to substantiate her claim, the petitioner has enclosed the Family Member Certificate issued by the competent authority. By virtue of the same, she is seeking death benefits of her deceased husband, late M. Hanumantha Rao, and accordingly, submitted a representation to the respondent No.4. 4
4. Without going into the merits of the case, in order to put a quietus to the litigation, the Writ Petition is disposed of with the following direction:
The Respondent No.4 is hereby directed to dispose of the representation, dated 21.10.2017 submitted by the petitioner, in accordance with law, within a period of six (6) weeks from the date of receipt of copy of this order. No order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed. ______________________________ MAHESWARA RAO KUNCHEAM, J Date:02.01.2026 ARB
