APP Mr. Imran Siddiqui … for the State-respondent(s) Learned advocate for the petitioner submits that the total seizure in the present case is 138 bottles of phensedyl and the petitioner has been implicated for alleged recovery of 52 bottles of phensedyl. Learned advocate, therefore, prays that the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that the investigation of the case is still in progress. Having considered that the investigation of the case is in progress, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. 2 However, the learned trial court would, after the charge-sheet is submitted in connection with the instant case, considering the factum of present seizure [if there is no further seizure], leniently consider the prayer for bail of the present petitioner.
