The applicant has preferred this First Bail Application under Section 483 of B.N.S.S. for grant of regular bail, as he has been arrested in connection with Crime No. 25/2026, registered at Police Station - Sarsiwan, District : Sarangarh - Bilaigarh, (C.G) for the offence punishable under Sections 296, 115(2), 351(2), 191(2) & 109 of the BNS. Maheshwari Sahu made complaint against the accused persons stating therein that the present applicant Dharam Sahu along with other accused persons with common intention abused the husband of complainant namely Ghanshyam Sahu and also threatened to kill him and then assaulted him by fist and kick and beaten him, cause of which he sustained grievous injuries. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that the prosecution case is accepted as it stands, the nature of the injuries does not prima facie justify framing of a charge under Section 109 of the Bharatiya Nyaya Sanhita. The applicant has remained in judicial custody since 01.04.2026, the charge-sheet has already been filed, and no further custodial interrogation is required. As the trial is likely to take considerable time to conclude, his continued detention is unwarranted. The applicant is a permanent resident of the address mentioned in the cause title and there is no likelihood of his absconding or tampering with the prosecution evidence if released on bail. Accordingly, the applicant deserves to be enlarged on regular bail. 4. Learned State counsel opposed the bail application and submitted that a perusal of the case diary reveals that the present applicant, along with the other co-accused, assaulted the 3 injured, Ghanshyam Sahu, causing injuries to his abdomen, left arm, and waist. It was further submitted that the injured remained admitted at Balaji Hospital, Raipur, for 10 days and is undergoing treatment. The medical documents forming part of the case diary describe the injuries as serious, caused by fists and kicks, and opine that they were sufficient to endanger life. In view of the serious nature of the injuries and the allegations against the applicant, learned State counsel prayed for rejection of the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Having considered the rival submissions, the case diary, and the material available on record, this Court finds that there are specific allegations against the present applicant. The case diary prima facie reveals that the applicant, along with the co-accused persons, assaulted the injured, Ghanshyam Sahu. The medical documents further show that the injured sustained serious injuries to his abdomen, left arm, and waist, remained admitted at Balaji Hospital, Raipur, for 10 days, and the doctor has opined that the injuries were sufficient to endanger life. Considering the nature and gravity of the allegations, the seriousness of the injuries sustained by the victim, and the material available on record, this Court is of the considered opinion that it is not a fit case to exercise its discretion in favour of the applicant. Accordingly, without expressing any opinion on the merits of the 4 case, the present bail application is dismissed. 7. Accordingly, the bail application of the applicant – Dharamlal Sahu, involved in Crime No. 25/2026, registered at Police Station - Sarsiwan, District : Sarangarh - Bilaigarh, (C.G) for the offence punishable under Sections 296, 115(2), 351(2), 191(2) & 109 of the BNS, is rejected.
