Prayer in the present petition preferred under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of anticipatory bail to the petitioner in case FIR No.55 dated 25.06.2025 registered under Sections 420, 511, 465, 468 and 471 of IPC, 1860, at Police Station North, District Chandigarh.
2. On 07.05.2026, the following order was passed by a Coordinate Bench:-
“The instant petition under Section 482 of BNSS, 2023 (438 of Cr.P.C.), has been filed for grant of anticipatory bail to the petitioner in case FIR No.55 dated 25.06.2025, registered under Sections 420, 511, 465, 468 and 471 of IPC, 1860, at Police Station North, District Chandigarh. Learned counsel for the petitioner submitted that case of the petitioner is on same footings as that of co-accused, namely, Vijay Kumar, Niranjan Kumar and Ajit Kumar, who have already been released on regular bail by this Court vide common
order dated 13.02.2026 passed in CRM-M-71609-2025, CRM-M-71435-2025 and CRM-M-72026-2025 respectively and co-accused Devender Mor, has also been released on regular bail vide order dated 28.11.2025 passed in CRM-M-64832-2025. It is further submitted that co-accused Sahil has also been granted concession of anticipatory bail by Hon’ble Supreme Court in case titled ‘Sahil Vs. State of U.T., Chandigarh’ in SLP(Crl.) No.11461 of 2025, decided on 10.12.2025. Notice of motion. Mr. Manish Bansal, P.P., U.T. Chandigarh, accepted notice on behalf of the respondent and submitted that he has no objection, if the petitioner released on interim bail in view of
order passed in aforesaid SLP. Heard. Keeping in view the facts and circumstances of the present case and the fact that co-accused, namely, Vijay Kumar, Niranjan Kumar and Ajit Kumar, have already been granted concession of regular bail by this Court vide common order dated 13.02.2026 passed in CRM-M-71609-2025, CRM-M-71435-2025 and CRM-M-72026-2025 and co-accused Devender Mor, has also been released on regular bail vide order dated 28.11.2025 passed in CRM-M-64832-2025, the petitioner is directed to join investigation as and when required by the Investigating Officer. In the event of arrest, the petitioner be released on interim bail on furnishing personal bail/surety bonds to the satisfaction of Arresting/Investigating Officer till the next date of hearing subject to the conditions as envisaged under Section 482(2) of the BNSS (erstwhile Section 438(2) Cr.P.C.). Learned counsel for the petitioner submits that in compliance of the aforesaid order dated 07.05.2026, the petitioner has duly joined investigation.

Learned counsel representing UT Chandigarh submits that in compliance of the order dated 07.05.2026, the petitioner has duly joined in- vestigation and his custodial interrogation is not required.
5. In view of the fact that the petitioner has duly joined investigation and keeping in view the statement given by learned counsel representing UT Chandigarh, the present petition is allowed. The order dated 07.05.2026 is made absolute, subject to compliance of the provisions as envisaged under Section 482(2) of the BNSS.
