JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in S.C.No.96/2026 pending before the Court of III Additional District and Sessions Judge, Tumakuru arising out of Crime No.36/2026 registered by Tumakuru Rural Police Station for the offences punishable under Sections 310(4) and 310(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 is before this Court in this petition filed under Section 483 of Bharathiya Nagarika Suraksha Sanhita, 2023 seeking regular bail. 2. Heard learned counsel for the parties. 3. FIR in Crime No.36/2026 was registered by the Tumakuru Rural Police Station, Tumakuru for the aforesaid - 3 - HC-KAR CNR: KAHC010373572026 NC: 2026:KHC:36248 CRL.P No. 7798 of 2026 offences against five unknown persons based on the first information dated 15.02.2026 received from Bharathi S.C, Police Officer attached to Tumakuru Rural Police Station. In the said case, the petitioner was arrested on 16.02.2026 and remanded to judicial custody. His bail application filed before the Trial Court in Crl.Misc.No.779/2026 was rejected on 26.05.2026 and therefore, he is before this Court. 4. Based on the credible information received on 15.02.2026 at about 9.10 p.m. to the effect that some persons armed with weapons had made preparations to commit docoity within the jurisdiction of Tumakuru Rural Police Station, FIR was registered in Crime No.36/2026 against four to five unknown persons for the aforesaid offences. During the raid that was conducted to the alleged spot where the accused persons were allegedly making preparations to commit docoity, the petitioner and other accused persons were arrested and from their - 4 - HC-KAR CNR: KAHC010373572026 NC: 2026:KHC:36248 CRL.P No. 7798 of 2026 possession, the weapons, which they were holding, were also recovered. After completing investigation, charge sheet has been now filed as against five accused persons. The alleged offences are not punishable with death or imprisonment for life. 5. Insofar as the other criminal cases registered against the petitioner are concerned, he has been enlarged on bail. He has undertaken to cooperate with the Trial Court for expeditious disposal of the case and has also undertaken to abide by all the conditions that would be imposed on him. Considering the nature of allegations found in the present case as against the petitioner, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmative. 6. Accordingly, the following: ORDER (i) The Criminal Petition is allowed. - 5 - HC-KAR CNR: KAHC010373572026 NC: 2026:KHC:36248 CRL.P No. 7798 of 2026 (ii) The petitioner is directed to be enlarged on bail in S.C.No.96/2026 pending before the Court of III Additional District and Sessions Judge, Tumakuru arising out of Crime No.36/2026 registered by Tumakuru Rural Police Station for the offences punishable under Sections 310(4) and 310(5) of the BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with one local surety and two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Petitioner shall not involve in similar offences in future; - 6 - HC-KAR CNR: KAHC010373572026 NC: 2026:KHC:36248 CRL.P No. 7798 of 2026 e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) Petitioner shall appear before the Station House Officer, Tumakuru Rural Police Station on 2nd Sunday of every month and mark his attendance between 10.30 a.m. and 1.30 p.m. for a period of one year from the date of his release from custody.
