Learned advocate appearing for the petitioner submits that the petitioner is in custody for one year ten months and out of 14 witnesses till date only one witness has been examined and the subject matter of the case relate to alleged recovery of 37 kgs of ganja. Learned advocate appearing for the State opposes the prayer for bail and submits that the bail of co-accused has been rejected by the Hon’ble Supreme Court in SLP (Crl.) 19317 of 2026. Additionally, petitioner had a previous offence under the NDPS Act where he has been acquitted. Having considered that very recently on 20.05.2026 the bail of the co-accused has been rejected by the Hon’ble Supreme Court, I am not inclined to release the petitioner on bail at this stage. 2 Accordingly, CRM (NDPS) 1048 of 2026 is dismissed. Learned trial Court is directed to expedite the process of law. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
