JUSTICE H.S.GREWAL Present: Mr. PPS Brar, Advocate for the petitioner. **** H.S. GREWAL, J. (ORAL) CRM-26838-2026 Allowed as prayed for. Main case: 1. This petition has been filed under section 528 of Bhartiya Nagarik Suraksha Sanhita, 2023/Section 482 of the Code of Criminal Procedure for issuance of a Direction, Directing the respondents no. 1 to 4 to register a First Information Report (FIR) against respondents nos. 5 to 9 for the offence of Voluntarily Causing Grievous hurt, criminal intimidation, Criminal trespass, Mischief, unlawful assembly, threats to life and property under sections 118(2) (326 IPC), 351 (506 IPC), 329 (447 IPC), 324 (425 IPC), 189 (141/142 IPC), 190 (149 IPC), 191 (146/147 IPC) of the Bharatiya Nyaya Sanhita, 2023, and to conduct a fair and impartial investigation thereof. 2. Learned counsel for the petitioners submits that on 04.06.2026, the private respondents, armed with deadly weapons, attempted to forcibly grab the land belonging to the husband of petitioner No.1. When the petitioners resisted the said attempt, they were allegedly assaulted, and petitioner No.1 sustained grievous injuries, which are duly supported by the RENU RAWAT 2026.07.10 17.14 I attest to the accuracy and integrity of this document Chandigarh CRM-M-36435-2026 2 Medico-Legal Report (MLR). It is further submitted that despite the disclosure of cognizable offences and repeated representations made to the official respondents, no FIR has been registered. Instead, the official respondents are allegedly pressurising the petitioners to enter into a compromise with the private respondents. It is further contended that the petitioners are being repeatedly summoned and threatened by the official respondents, thereby compelling them to approach this Court by way of the present writ petition. 3. Notice of motion to the official respondents. 4. Mr. P.S.Pandher, AAG, Punjab accepts notice on behalf of respondent No. 1 to 4 and submits that investigation shall be carried out as per law. 5. I have heard learned counsel for the parties and perused the record. 6. Keeping in view the above and the assurance given by learned State counsel, this Court finds no ground to interfere with the investigation being conducted by the Investigating Agency. However, it is directed that, if the presence of the petitioner is required in connection with the investigation of her own case, the official respondents shall issue a three days advance notice to her, in accordance with law. 7. Accordingly, the present petition stands disposed of.
