Bhowmick … for the petitioner Ms. Priti Kar Bagchi … for the State Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 195 bottles of phensedyl. There is no recovery from the present petitioner. The petitioner is in custody for 4 months 20 days. Charge-sheet has been submitted before the jurisdictional court. The petitioner may be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that pursuant to the petitioner being arrested, there has been recovery at the instance of the present petitioner. There are criminal antecedents of the present petitioner which incorporate four cases under the NDPS Act as well as other heinous offences. Having considered the previous antecedents of the present petitioner and that there has been recovery from the present petitioner, at this stage, I am not inclined to release 2 the petitioner on bail. The petitioner will renew the prayer for bail after the evidence of seizure list witnesses are over. Thus, CRM(NDPS) 1054 of 2026 is dismissed.
