This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), Additional Court, Berhampore to dispose of the final decree proceeding in connection with Partititon Suit No. 190 of 2001 expeditiously. Learned advocate appearing for the petitioners submits that the preliminary decree was passed sometime in the year 2006 and the final decree proceeding is pending since 2007. She submits that March 11, 2026 was fixed for further cross- examination of the learned Advocate Commissioner. She further submits that August 20, 2026 has been fixed for further cross-examination of the learned Advocate Commissioner. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along
2 with this order, upon the opposite parties or upon the learned advocate representing them before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioners, CO 1527 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), Additional Court, Berhampore to make an endeavour to dispose of the partition suit no. 190 of 2001 as expeditiously as possible but positively within six months from the next date fixed.
