1. Heard the learned advocates for the parties.
2. Earlier on 24.06.2024 we recorded an order that since the West Bengal Administrative Tribunal (in short ‘Tribunal’) was non-functional, the petitioner was required to approach the writ court instead of Tribunal in respect of the relief arising out of the petitioner’s transfer. We allowed time to the learned advocate for the writ petitioner to come back with instructions.
3. When the matter is taken up today, learned advocate for the petitioner submits that the present case may be sent to the Hon’ble Single Judge for consideration. There is no scope of passing such order.
4. The learned advocate for the petitioner submits that the petitioner cannot avail the remedy before the learned Single Judge’s Bench unless
2 the O.A.671 of 2025, filed before the Tribunal is withdrawn. Since the Tribunal is non-functional for want of any Member, the petitioner does not have the option of withdrawing the pending O.A. as there is no forum available for passing the order.
5. In view of such submission, we dispose of the O.A. being No.671 of 2025 pending before the Tribunal and leave it for the petitioner to take steps and avail the remedy before the Hon’ble Single Judge dealing with the determination of service matters.
6. The present writ petition is accordingly disposed of.
