JUSTICE D K SINGH) The present appeal under Section 19(1) of the Family Courts Act, 1984, has been filed by the appellant/wife impugning the judgment and decree dated 01.12.2018 passed by the IV Additional Principal Judge, Family Court, Bengaluru, in M.C.No.4225/2016 filed by the respondent/husband praying for a decree of divorce for dissolving their marriage solemnized on 24.11.2008. 2. Out of the wedlock, a male child was born on 11.11.2009 and a female child was born on 20.10.2013. The daughter is staying with the mother and the son is staying with the father. 3. The learned counsel for the appellant/wife does not dispute the judgment and decree so far as divorce is - 3 - HC-KAR NC: 2026:KHC:35897-DB MFA No. 1243 of 2019 concerned, however she is aggrieved by non grant of maintenance to her. 4. Learned counsel for the respondent/husband does not seriously dispute that he would be liable to maintain the daughter born out of wedlock and the wife also, but she has said that this Court should fix reasonable maintenance. 5. Considering the status of the parties and the fact that the female child is 14 years of age as on today, there are educational and other expenses which are to be incurred, we, therefore fix the monthly maintenance to the daughter namely, Kumari Srushti at Rs.20,000/- per month and Rs.15,000/- to the appellant/wife for the time being. 6. Any further modification of this maintenance should be done by the Family Court on considering the relevant factors as may be pointed out by the parties after hearing them. - 4 - HC-KAR NC: 2026:KHC:35897-DB MFA No. 1243 of 2019 7. With the aforesaid modification, we affirm the decree of divorce dissolving the marriage between the parties. The appeal stands disposed of accordingly.
