CORAM:
HON’BLE MISS JUSTICE SAVITRI RATHO
ORDER 11.03.2026
Order No.
05. (Through hybrid mode)
1. Perusal of the office note indicates that in order dated 17.02.2026, the adjournment date has been inadvertently typed as ‘09.03.2025’ in place of ’09.03.2026’. The said typographical error be corrected. 2. This CRLMP has been filed for a direction to the Opposite Party No.4 to dispose of the representation dated 03.07.2025 vide Annexure-9 where permission to sell the vehicle bearing No. OR- 02AP-4141 which has been given in the zima of the Petitioner by way of zimanama executed on 15.11.2018. 3. Mr. S.R. Polai, learned counsel for the Petitioner submits that the Petitioner is registered owner of Maruti Swift VDI car bearing
Registration No. OR-02AP-4141. It had been seized in connection of Bhubaneswar Vigilance P.S. Case No. 12 of 2018 which corresponds to V.G.R. Case No. 54 of 2018 pending in the Court of the learned Special Judge (Vigilance), Bhubaneswar. The case has been registered against one Sankar Narayan Choudhury. The car in question had been seized from the possession of the accused Sankar Narayan Choudhury, Junior Engineer MVI, Bhadrak by seizure list dated 15.11.2018 during investigation and had been released in his zima. During investigation, it was found that the vehicle does not belong to the accused and is not required for investigation in Cuttack Vigilance P.S. Case No. 12/ 2018. So the I.O. has no objection if the car is released completely in favour of the Petitioner and disposed of by him. 4. It is also stated that since seizure and zima has already been intimated to the Court of the learned Special Judge (Vigilance), Bhubaneswar, the I.O. has no jurisdiction to release the said car in favour of the Petitioner. 5. It appears that the Petitioner who is the registered owner of Maruti Swift VDI car bearing Registration No. OR-02AP-4141, has been running from pillar to post for release of the vehicle which the I.O. has admitted is not required for investigation of the case and he
puspa has no objection if the car is released finally in favour of the Petitioner. 6. It is therefore open to the Petitioner to file an application under Section 457 of Cr.P.C. for release of vehicle before the learned Special Judge, Vigilance, Bhubaneswar along with ownership documents.
The learned Special Judge, Vigilance, Bhubaneswar shall do well to dispose of the application for release of the vehicle which had earlier been given in zima of the accused Sankar Narayan Choudhury taking into consideration the affidavit filed on behalf of the vigilance by the I.O. that the vehicle is not required for investigation of the case and may be released finally in favour of the Petitioner. 7. Thereafter, it will be open to the Petitioner to deal with the vehicle as he likes. 8. The CRLMP is accordingly disposed of. 9. Urgent certified copy of this order be granted on proper application.
