JUSTICE RAVI V HOSMANI ORAL ORDER Challenging proceedings in C.C.no.306/2019 on file of Civil Judge and JMFC, Doddaballapura, Bangalore Rural District, for offences punishable under Sections 403, 406, 409, 420, 477(A) read with 120(B) and 34 of Indian Penal Code, 1860, this petition is filed. - 3 - HC-KAR NC: 2026:KHC:35753 CRL.P No. 2857 of 2019 2. Heard Sri Subramanya H.V., learned counsel for petitioners and Sri Lokesh C., learned counsel for respondent no.2. 3. Learned counsel for respondent no.2 submits that during pendency of above petition, there was settlement between parties and a joint memo signed by respective parties along with joint affidavit is filed. As per terms of joint memo, respondent no.2 has no objection for this petition being allowed quashing charge sheet. 4. Parties are present and are identified by their respective counsel. On interaction, they affirmed terms and conditions of joint memo and about settlement being voluntary without any threat, coercion or inducement. 5. Though present proceedings arise out of a private complaint filed alleging commission of cognizable and non- cognizable offences, perusal of averments in complaint would indicate that dispute arose in trade union activities and purely intra-union without any effect on workers or society at large. - 4 - HC-KAR NC: 2026:KHC:35753 CRL.P No. 2857 of 2019 6. It is submitted by learned counsel for respondent no.2, on instructions, that complaint was filed in spur of moment and subsequent audit reports did not reveal any irregularities. Therefore, settlement was bona fide. 7. In view of above, as allegations were made in spur of moment and offences alleged do not have any bearing on society and subsequent audit reports are stated to have ruled out irregularities, complainant does not wish to pursue complaint. As such continuation of proceedings would be futile. 8. In view of above, not only to secure ends of justice as per settlement but also to prevent abuse of process, petition is allowed, proceedings in C.C.no.306/2019 on file of Civil Judge and JMFC, Doddaballapura, Bangalore Rural District, stand quashed.
