The case of the prosecution is that the petitioner has committed sexual assault on the victim girl. Hence the case. 3. The learned counsel appearing for the petitioner would submit that the petitioner was remanded to judicial custody on 21.03.2026. It is the contention of the learned counsel that both the petitioner and the victim are related to each other and they were in relationship and hence prays for grant of bail to the petitioner. 4. At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police has submitted the statement of the victim girl recorded under Section 183 of B.N.S.S. before the Judicial Magistrate No.I, Poonamallee, Tiruvallur District. 5. I have given anxious consideration to the submissions made by the learned counsel on either side. 6. From the statement of the victim under Section 183 of B.N.S.S., this Court could not find any forcible sexual assault made by the petitioner on the victim girl and this Court could only find affair between the petitioner and the victim girl. Therefore, taking into consideration of the totality of circumstances and upon the averments made in the statement recorded under Section 183 of https://www.mhc.tn.gov.in/judis CRL OP No. 9228 of 2026 __________ Page3 of 5 B.N.S.S. given by the victim girl, this Court is inclined to enlarge the petitioner on bail, subject to the following stringent conditions: 7.
