The petitioner is an accused in connection with Daltonganj Town PS Case No. 205/2021. The petitioner as the Honorary Secretary of the District Literacy Committee had made expenditure much more than the sanctioned budget in the purchase of teaching and learning materials. Submission has been advanced by the learned counsel for the petitioner that the incident is of the year 2006 and there has been an inordinate delay in institution of the First Information Report. Learned counsel adds that the petitioner does not have any criminal antecedent and he is in custody since 04.02.2026. It has further been submitted that the decision to purchase was taken by the purchase committee which was headed by the DDC and the supply order was issued thereafter by floating a tender. The learned Spl.P.P. has opposed the prayer for bail of the petitioner. Regard being had to the inordinate delay in institution of the First Information Report and the submission of the learned counsel for the petitioner that the supply order was placed by following the rules and regulations, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Daltonganj in connection with Daltonganj Town PS Case No. 205/2021.
