Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that the petitioners and informant, both are agnates and relating to construction of road, the said scuffling took place on the family members. Counsel submits that upon bare perusal of the FIR, there is nothing specific against anyone. However, a bare perusal of the FIR reveals that no specific overt act has been attributed to the petitioner, nor can it be ascertained from the FIR as to who caused the alleged grievous injury. Counsel submits that the criminal antecedent of the petitioners is clean and it is a family dispute which is unfortunately registered as Police Case.
Counsel further submits that petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them. 5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that the petitioners and informant are agnates and it is a family dispute between the petitioners and informant.
