Learned counsel further submits that due to inadvertence, the applicants could not rectify the default and as soon as they came to know about dismissal of the appeal, the instant MCC was filed immediately on 21.1.2021 i.e. within 14 days from the date of dismissal. Hence, the present MCC may be allowed and the said appeal be restored to its original number. 02. Learned counsel appearing for the respondents has no objection to the aforesaid prayer of the applicants. 03. Heard learned counsel for the parties. 04. On due consideration, the MCC is allowed.
