AGP, Ms. Ranjana Chatterjee … for the State. 1. The substantial relief claimed in the Original Application was acceptance of the petitioner’s resignation with effect from 13.02.2019. The writ petitioner was the applicant before the Tribunal posted as a Resident Medical Officer cum Clinical Tutor, Department of Paediatrics at the Medical College and Hospital, Kolkata. 2. He submitted an application for resignation with effect from 13.02.2019 which was dated 21.03.2025. The Original Application was filed since the petitioner’s application for resignation was not being considered/allowed. 3. When the matter is called on today the learned advocate for the writ petitioner/applicant has handed over a copy of an order dated 11.06.2026 issued by the Special Secretary to the Government of West Bengal in the Health and Family Welfare Department whereby and whereunder the petitioner’s application for resignation was accepted and past services as a consequence thereto were to be forfeited. The order entails refund of one 2 month salary by the writ petitioner including excess salary paid to him for certain period specified therein. The formal order was to follow on completion of formalities and discharge of financial obligations by the writ petitioner. 4. The learned advocate for the writ petitioner submits that the order dated 11.05.2026 has rendered the present proceeding infructuous. 5. Copy of the order dated 11.06.2026 is kept on record. 6. The parties are in agreement that in view of the order dated 11.06.2026 passed by the Special Secretary, pendency of the Original Application bearing O.A. No. 363 of 2025 before the Tribunal would be an exercise in futility. 7. The writ petition is accordingly disposed of. 8. The Original Application is also disposed of. 9.
