The Panchayat is not represented despite service. The petitioner alleges that some miscreants are raising unauthorized construction in the plot in question without obtaining sanction from the concerned Panchayat. The petitioners submitted representations in this regard before the various authorities which have not been considered. The petitioner seeks consideration of the same.
Learned counsel for the State submits that pursuant to the representations submitted by the petitioner, the Block Development Officer, Bongaon has held a preliminary inspection and is yet to get a detailed and effective report on the issue. Since the representations submitted by the petitioner before the Panchayat and other authorities are pending, the Block Development Officer, Bongaon, being
the 7th respondent herein and the Pradhan, Ganrapota Gram Panchayat, being the 8th respondent herein, are
directed to consider and dispose of the representations within four weeks from the date of communication of this
order and upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event any unauthorized construction is found on the plot in question, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
