THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE SMT. JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayers: “i) Issue a writ of mandamus by issuing the direction to the Hon'ble VII Additional City Civil & Sessions Judge at Bengaluru(CCH-19) in O.S.No.2956/2025 to dispose of the I.A.No.3 under Order XLVII Rule 1 R/w section 114 & section 151 of C.P.C for review and recall order passed on I.A.No.1 & 2 dated, 03-01-2026, vide ANNEXURE-L, and consequently issue direction to dispose of the O.S. No.2956/2025, within the stipulated time limit to meet the ends of justice. ii) Pass such other order as this Hon'ble Court deems fit and necessary under the facts and circumstances of the case.” - 4 - HC-KAR NC: 2026:KHC:35243 WP No. 20049 of 2026 2. The petitioners are seeking writ of mandamus to dispose of IA No.3 filed on 17.02.2025 in O.S.No.2956/2025 by the VII Additional City Civil & Sessions Judge at Bengaluru(CCH-19). Considering the fact that IA No.3 is filed on 17.02.2025, there shall be a direction to the Trial Court to dispose of the same within a period of 4 weeks. 3. As far as the other prayer seeking a direction to dispose of O.S.No.2956/2025, which is pending on the file of the VII Additional City Civil & Sessions Judge at Bengaluru(CCH-19), where the matters are pending which are more than 10 years old and this Court cannot issue a mandamus to the trial Court to dispose of a matter of the year 2025. 4. In that view of the matter, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of, requesting the Trial Court to dispose of IA No.3 within a period of four weeks from the date of receipt of a copy of the order. - 5 - HC-KAR NC: 2026:KHC:35243 WP No. 20049 of 2026 ii.
