This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Tumudibandha P.S. Case No. 169 of 2024 corresponding to C.T. Case No. 86 of 2024 pending in the file of learned Addl. District & Sessions Judge-cum- Special Court under (POCSO) Act, Kandhamal, for commission of offences punishable U/Ss. 137(2)/ 3(5)/ 87/351(2)(3)/296/65(1)/64(2)(m) of BNS r/w Sec. 4(2)/ 6(1) of POCSO Act and Sec.67(B) of IT Act, on the main allegation of kidnapping the victim and committing rape and aggravated penetrative sexual assault upon her and getting her nude and obscene photographs and videos viral. 2. Heard, Mr. Rabindra Kumar Pattanaik, learned counsel for the petitioner, Mr. S.C. Pradhan, learned Addl. PP and Mr. Subhranshu Jena, learned counsel for the informant in the matter and perused the record. 3. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the materials placed on record together with the statement of the victim and keeping in view the other circumstances on record in entirety, this Court is not inclined to grant bail to the petitioner at this stage. 4. Hence the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of.
