1. The petitioner was the applicant before the West Bengal Administrative Tribunal (in short ‘Tribunal’). The substance of the relief was acceptance of the petitioner’s resignation.
2. When the matter is called on today, the learned advocate for the petitioner has handed over a copy of an order dated 2nd July, 2026 issued by the Special Secretary to the Government of West Bengal, Health & Family Welfare Department.
3. As per the order, the petitioner’s resignation was accepted from the post of R.M.O. cum Clinical Tutor in the Department of SDLD, IPGME&R at SSKM Hospital, Kolkata w.e.f. 26.07.2014. As a consequence thereto, his past services were forfeited. The order records that the formal release order will be issued after completion of
2 formalities including financial obligations on the part of the writ petitioner.
4. As per the learned advocate for the writ petitioner, the prayer made in the writ petition is rendered infructuous on account of the order dated 02.07.2026 issued by the Special Secretary to the Government of West Bengal.
5. Accordingly, the writ petition is disposed of. Copy of the order dated 02.07.2026 is kept on record.
6. The parties are in agreement that in view of the order dated 02.07.2026, pendency of the Original Application bearing O.A. No.37 of 2026 before the West Bengal Administrative Tribunal, would serve no useful purpose and would be futile.
7. The Original Application (O.A. No.37 OF 2026) is, accordingly, disposed of.
