1. Heard Mr. P. Bharadwaj, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.
2. This application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for pre-arrest bail in respect of Samaguri P.S. Case No.08/2026 under Sections 82(1)/85 of the BNS, 2023.
3. The informant is the wife of the present petitioner. They have an 11 year old
Page No.# 2/2 daughter, in spite of that the petitioner married again and started to quarrel with the informant. Ultimately, the informant, being the first wife has to leave her matrimonial home and presently she has been living in the house of her parents, whereas the petitioner has been living in his house with his second wife. Moreover, the petitioner has not been given any maintenance to the informant (first wife).
4. After a plain reading of the FIR, this Court is of the opinion that for the allegation brought against the present petitioner, he does not deserve to be detained in custody.
5. The pre-arrest bail application of the petitioner is allowed.
6. It is hereby directed that in the event of arrest in connection with Samaguri P.S. Case No.08/2026, the petitioner Phuleswar Doimari shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the arresting authority.
7. The petitioner shall co-operate with the Police Investigating Officer as and when called for.
8. With the aforesaid direction, this pre-arrest bail application stands disposed of. JUDGE Comparing Assistant
