GP FOR REVENUE The Court made the following: ::ORDER :: The above writ petition was filed to declare the action of respondent No.5 in attempting to dispossess the petitioners from the house plot Nos. 152 & 151 in Sy.No.1769C/1A of Owk Village and Mandal, Nandyala District, without issuing any notice, as illegal and arbitrary. Page 3 of 5 2. Heard Sri Varun Byreddy, learned counsel for the petitioners, Sri Panuku Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj, appeared for respondent No.1, Sri M. Chandra Sekhar, learned Assistant Government Pleader for Revenue, appeared for respondents 2 to 4 and Ms. Kavitha, learned counsel representing Sri M. Sudhir, learned Standing Counsel, appeared for respondent No.5. 3. Learned counsel for the petitioners would submit that the 1st petitioner purchased the Plot No.152, admeasuring 93.79 Square Yards in Sy.No.1769C/1A under a registered sale deed dated 29.02.2024. The 2nd petitioner purchased the Plot No.151, admeasuring 108.60 Square Yards in Sy.No.1769C/1A under a registered sale deed dated 27.02.2024. Since then, the petitioners have been in possession and enjoyment of the open plots. The Panchayat Secretary of respondent No.5, without issuing any notice, is attempting to dispossess the petitioners. 4. Ms. Kavitha, learned counsel representing Sri M. Sudhir, learned Standing Counsel appearing for respondent No.5, on instructions, would submit that the Panchayat Development Officer- respondent No.5 issued two notices dated 06.06.2026 to the petitioners calling upon them to submit documents enabling the authority to lay CC road and construct a drainage. She would also submit that respondent No.5 never attempted to dispossess the petitioners. Copies of notices were handed over to learned counsel for the petitioners across the bar. 5. In reply, Sri Varun Byreddy, learned counsel for the petitioners’ would submit that the petitioners will submit an explanation along with the relevant documents, within one week from today. The same is recorded. 6. Given the facts and circumstances of the case, keeping the writ petition pending, inviting a counter-affidavit will not serve any purpose. Hence, the Writ Petition is disposed of at the stage of admission with the consent of learned counsel appearing on either side, directing the petitioners to submit an explanation along with the relevant documents to the notices issued on 06.06.2026 by the Panchayat Development Officer – respondent No.5, within seven (07) days from today. Thereupon, the Panchayat Development Officer shall consider the same and pass appropriate orders, strictly as per the Rules, if necessary, by providing an opportunity of hearing to the petitioners. The authorities shall not take any coercive steps concerning the aforementioned plot numbers without following due procedure. No order as to costs.
