ORAL ORDER Accused No.6 in S.C.No.42/2025 pending before the Court of I Additional District & Sessions Judge, Chikkaballapura, arising out of Crime No.22/2025 registered by Chikkaballapura Rural Police Station, Chikkaballapura, for the offences punishable under Sections 103(2), 61(1)(b), 190, 238 of the Bharatiya Nyaya Sanhita, (BNS) 2023, is before this Court under Section 483 of the Bharatiya Nagarika Suraksha Sanhita, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.22/2025 was registered by Chikkaballapura Rural Police, Chikkaballapura, against one Praveen Nayaka and others based on the first information dated 04.02.2025 received from Keshava M, the brother of

deceased-Subash. Petitioner who was arrayed as accused No.3 in the FIR was arrested in the present case on 04.02.2025 and was remanded to judicial custody. After completing investigation, the charge sheet has been filed against 11 persons and petitioner is arrayed as accused No.6 in the charge sheet. His bail application filed before the Trial Court in S.C.No.42/2025 was rejected on
29.04.2026. Therefore, the petitioner is before this Court.
4. Learned Counsel for the petitioner submits that all the other accused except the petitioner herein have been granted regular bail in the present case. He submits that as against petitioner another criminal case is registered in which accused No.1 in the present case is also arrayed as an accused. In the said case, petitioner has been granted bail. Accordingly, learned Counsel prays to allow the petition.
5. Per contra, learned Additional Special Public Prosecutor, who has opposed the petition does not dispute

the submissions made by learned Counsel for the petitioner.
6. A reading of the charge sheet would go to show that on the alleged date of incident, petitioner along with accused Nos.1, 4, 9 and 12 had travelled in a car, which was driven by accused No.4. The allegation of assaulting the deceased in the incident that took place at about 11 p.m. on 03.02.2025 is found in the charge sheet as against accused Nos.1, 2, 6 and 8. Accused Nos.3 to 7 and 10 and 11 were allegedly standing near the Canal in
order to see that deceased should not escape from the spot. Accused No.9 allegedly had held the shirt of the deceased when accused Nos.1, 2, 6 and 8 assaulted him and committed his murder.
7. Accused No.1 has been granted regular bail by the Co-ordinate Bench of this Court in Criminal Petition No.14608/2025 disposed of on 16.03.2026 and accused No.2 has been granted regular bail in Criminal Petition No.4340/2026, disposed of on 27.04.2026. Accused No.8

has been granted regular bail in Criminal Petition No.16872/2025 disposed of on 21.04.2026. Accused No.9 has been granted regular bail in Criminal Petition No.15592/2025, disposed of on 21.01.2026. All the accused as against whom, similar allegations found in the charge sheet are now granted regular bail in the present case. It is also not in dispute that all the other accused in the present case have been granted regular bail except the petitioner. Considering the aforesaid aspects of the matter, I am of the view that without expressing any opinion on the merits/demerits of the case, the petitioner's prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following:
ORDER The Criminal Petition is allowed. Petitioner is directed to be enlarged on bail in S.C.No.42/2025 pending before the Court of I Additional District & Sessions Judge, Chikkaballapura, arising out of Crime No.22/2025 registered by

Chikkaballapura Rural Police Station, Chikkaballapura, for the offences punishable under Sections 103(2), 61(1)(b), 190, 238 of the BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Petitioner shall not involve in similar offences in future; and e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
