Mr. Shaunak Ghosh Ms. Shreyashi Maity ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Judge, 2nd Bench, City Civil Court at Calcutta to dispose of Title Suit No. 724 of 2018 expeditiously. The learned advocate appearing for the petitioner submits that application under Order 7 Rule 11 of the Code of Civil Procedure filed by the petitioner is pending. He submits that no date for hearing of such application has been fixed. C.O. 2280 of 2026 stands disposed of by giving liberty to the petitioner to approach the learned trial judge with the prayer for fixing a date of hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure. If such a prayer is made the learned trial judge shall consider the same and fix a date of hearing of the said application at the earliest. The learned trial judge shall make an endeavour to dispose of the application under 2 Order 7 Rule 11 of the Code of Civil Procedure expeditiously. There shall be, however, no order as to costs.
