APP Ms. Hasi Saha … for the State Learned advocate appearing for the petitioner submits that the petitioner is in custody since 20.12.2025 and the subject matter of the case relates to alleged recovery of 1 kg 206 gms of brown sugar. The petitioner has been implicated on the basis of the statement of the co-accused. Learned advocate appearing for the State opposes the prayer for bail but is unable to refute the contention that there is no recovery of brown sugar and the petitioner has been implicated in this case on the other materials collected in course of investigation. Charge-sheet has been submitted before the jurisdictional court and the prosecution has relied upon 15 witnesses in order to prove its case. Having regard to the time frame which will be required the trial to its logical conclusion, I am inclined to release the 2 petitioner on bail. As such, the prayer for bail of the present petitioner is allowed. The petitioner, namely, Md Saba Karim @ Saba Karim shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1020 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
