JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No. 501/2024, pending before the III Addl. Civil Judge and J.M.F.C Kanakapura, Ramanagara District, for the offences under Sections 420, 406 and 506 of Indian Penal Code. 2. Heard Sri.Chandan B.K., learned counsel appearing for the petitioner, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.B.Siddeswara, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 3 - HC-KAR NC: 2026:KHC:35889 CRL.P No. 9135 of 2026 filed a Joint Memo for Compromise along with the affidavits. The Joint Memo for Compromise reads as follows: "1. The Petitioner is facing trial in Crime No.130/2023, culminating in C.C.No.501/2024, arising out of Kanakapura Police Station, for the offences punishable under Sections 420 and 406 read with Section 34 of the Indian Penal Code, which is presently pending on the file of the Hon'ble Principal Civil Judge and JMFC, Kanakapura. The matter is presently posted for the appearance of the accused. 2. The parties submit that the disputes between them have been amicably resolved pursuant to the settlement arrived at in the connected civil suit. A Joint Compromise Petition has been filed in the said suit, and in paragraph No.12 thereof, the Respondent No.2/De facto Complainant has agreed to extend his full cooperation for quashing the aforesaid criminal proceedings. In view of the said settlement, no dispute or grievance now survives between the parties. 3. The Petitioner and the Respondent No.2/De facto Complainant have voluntarily entered into the present compromise without any force, coercion, undue influence, or misrepresentation and have jointly decided to seek quashing of the criminal proceedings in the interest of maintaining peace and harmony between them. The Petitioner respectfully prays that the averments made in the accompanying Criminal Petition may kindly be treated as part and parcel of this Joint Compromise Memo to avoid repetition. WHEREFORE, the petitioner and Victim most humbly pray this Hon'ble court be pleased to accept their joint compromise affidavit and permit them compound the offences made against him in Crime No.130/2023 In CC. No.501/2024, of Kanakapura Police Station for the offences punishable under u/ss 420, 406 r/w. 34 of Indian Penal Code, which is now pending before the Hon'ble Prl. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Joint Memo for Compromise as quoted supra being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.501/2024 pending before the III Addl.
